GENERAL TERMS AND CONDITIONS FOR THE USE OF THE SKI AREA

TERMS AND CONDITIONS OF USE

I. SCOPE

1.1. These general terms and conditions apply to:

the provision of services related to the sale of and travel using cable transport systems (ski lifts) carrying passengers;

the resolution of disputes arising in connection with these services;

the rules for using the services and facilities in the ski center (ski slopes, ski roads, cableways, transport belts, etc.) by tourists and the provision of access to the ski slopes;

the rules for safe behavior of tourists;

the rules for controlling compliance with the established order in the ski center in the Malyovitsa resort complex by “VI AI HUNTING” Ltd.

II. GENERAL PROVISIONS

2.1. The ski slopes in the Malyovitsa resort ski zone are accessible, secured, and clearly marked. Their maintenance is ensured by qualified personnel in accordance with safety standards, using the necessary equipment and techniques, and adapted to the specific weather conditions and terrain characteristics.

2.2. The passenger cableways (lifts) in the ski center of Malyovitsa are constructed and operated in compliance with the applicable legal regulations of the Republic of Bulgaria, meet safety requirements, are operated by qualified personnel, and are supervised by the competent authorities — the General Directorate for State Technical Supervision, Sofia.

2.3. The operating hours of the ski slopes in the Malyovitsa ski center correspond to the working hours of the lifts servicing them and depend on the specific weather conditions and avalanche risk.

2.4. “VI AI HUNTING” Ltd. reserves the right, at its own discretion, to close ski slopes and cableways for safety reasons in the following cases:

in case of inappropriate snow or weather conditions;

when technical maintenance of cable facilities is required;

when the slopes are being groomed;

in other cases provided for by applicable legislation.

2.5. Tourists using the Malyovitsa ski center are required to familiarize themselves with these general terms and conditions and to strictly comply with them. They must also observe publicly posted signs and instructions at the ski center, as well as follow instructions from the ski center personnel regarding the proper use of slopes and lifts to prevent incidents and avoid disruption of facility operations.

2.6. Tourists (or their parents/guardians in the case of minors) use the ski slopes at their own responsibility and risk when skiing or snowboarding in the Malyovitsa ski center.

2.7. “VI AI HUNTING” Ltd. EMPHASIZES that practicing snow sports (skiing, snowboarding, and similar activities involving movement over snow or ice) carries significant risks, and full responsibility for these risks lies with each individual tourist. Skiing or training, and using lifts is inherently dangerous and may result in pain, serious injury, death, or property damage. Each user is expected to assess their own readiness and accept these risks beforehand. “VI AI HUNTING” Ltd. bears no responsibility for the individual’s judgment or lack thereof, nor for any resulting consequences — personal or material.

2.8. Conditions on the slopes constantly change due to weather and usage. Risks include, but are not limited to: changes in snow quality, slope gradients, ice patches, exposed rocks or trees, manmade or natural obstacles, lift poles and infrastructure, snow production equipment, snow grooming machines, snowmobiles, and collisions with objects or other people.

2.9. “VI AI HUNTING” Ltd. WARNS that all risks mentioned above — even if not exhaustively listed — pose serious danger of physical and/or emotional discomfort, injury, or death.

2.10. Before using any ski center services, tourists are required to evaluate their own physical and mental condition, the weather conditions, and their skill level to determine whether they are capable of skiing/snowboarding and using lifts. They also must assess their readiness to accept all risks outlined in these terms. Any consequences due to failure or incorrect evaluation are fully at the individual’s own risk.

2.11. Tourists (or their guardians) are fully responsible for the condition of their equipment and proper adjustment of ski/snowboard bindings.

2.12. “VI AI HUNTING” Ltd. bears no liability and does not provide compensation for injuries or damages that are not solely due to the company’s conduct. By purchasing lift passes, users accept these conditions and cannot seek damages from the company, its owners, or its staff.

2.13. All lift passes issued by “VI AI HUNTING” Ltd. include accident insurance valid only during the winter season and only on marked slopes during official operating hours. The insurance covers:

First aid on the slope;

Free transport of the injured person by rescue equipment to a medical center.

2.14. The company does not provide insurance covering death, permanent disability, medical expenses, or repatriation. Tourists may obtain such insurance on their own initiative.

III. BASIC RULES FOR THE USE OF THE SKI CENTER

3.1. The working hours of all ski slopes correspond to the working hours of the cableways that serve them and are uninterrupted, except in the event of emergencies that require closure of slope(s).

3.2. Skiing or snowboarding on the ski slopes outside the officially announced working hours or after the declared closing time is not allowed.

3.3. The use of cableways and/or skiing or snowboarding by visibly intoxicated individuals or those under the influence of narcotic or intoxicating substances is prohibited.

3.4. The use of snowmobiles and ATVs on ski slopes within the ski center is prohibited, both during the day and at night. Exceptions are made only in cases of emergency medical assistance, police intervention, or technical issues with “VI AI HUNTING” Ltd.’s equipment.

IV. MANDATORY SAFETY RULES FOR TOURISTS AND SKIERS IN THE SKI CENTER OF MALYOVITSA

4.1. General rules

4.1.1. Every skier/snowboarder/cross-country skier is required to use only marked and open ski slopes and to comply with all placed markings and signs.

4.1.2. Skiing outside marked slopes, outside working hours, or on closed slopes or sections thereof is prohibited and is done entirely at the skier’s own risk.

4.1.3. All tourists must behave in a manner on the slopes and while using the lifts that does not endanger or obstruct themselves or others.

4.2. Rules for the conduct of tourists using skis or snowboards:

4.2.1. These rules apply to all users practicing skiing or snowboarding in Malyovitsa. Every skier or snowboarder must be aware of them and comply with them.

4.2.2. Users must:

  1. Adjust their speed and movement to their abilities, the terrain, snow conditions, weather, and traffic density. They must not endanger or obstruct others and must maintain full control of their skis or snowboard to change direction or stop safely when needed.

  2. Reduce speed in areas with poor visibility, near obstacles, intersections, splits, in fog, crowded areas, narrow sections, or near beginners.

  3. Be responsible not only for their behavior on the slope but also for the condition of their equipment. This also applies to unconventional gear (modified, prototype, etc.).

  4. Follow these slope movement rules:

a) Persons in front have the right of way. Those coming from behind must maintain distance and avoid causing danger to those ahead.

b) When overtaking, the overtaker must leave enough space for the overtaken person to move freely. The overtaker is fully responsible for executing the maneuver safely — including when overtaking stationary skiers or snowboarders.

c) Stopping on narrow or low-visibility sections of the slope is only allowed in emergencies. The stopped person must move away from the slope as soon as possible. Rejoining the slope must be done safely and without risk of collision.

d) After falling, the slope must be cleared as quickly as possible.

e) At intersections, skiers coming from the right have the right of way.

f) Moving against the direction of skiing, or walking up/down without skis or snowboard, must be done on the side of the slope.

  1. Comply with all signage and use slopes appropriate for their technical and physical capabilities.

  2. Yield to slope personnel and rescue services, as well as authorized transport vehicles. Do not obstruct their movement.

  3. In case of an accident, secure the area and immediately inform the rescue service by calling 1470 or 112.

4.3. All other alternative downhill activities are prohibited, including but not limited to: skibikes, snowbikes, airboards, paragliding take-off/landing on slopes, fat bikes, etc.

4.4. Sledding is allowed only in one specifically designated and secured section of the ski area.

V. CONDITIONS FOR ISSUANCE, SALE, VALIDITY, AND USE OF LIFT PASSES FOR CABLEWAYS IN THE SKI CENTER OF MALYOVITSA

5.1. All types of lift passes for using cableways in the ski center of Malyovitsa are issued and sold exclusively by “VI AI HUNTING” Ltd. at its ticket offices located at Mecha Polyana and at the reception of Hotel Malyovitsa.

5.2. Prices for the various types of lift passes are in Bulgarian lev (BGN), including VAT, and are published by “VI AI HUNTING” Ltd. on the ski area’s official website and at all ticket offices. The price list is posted in a visible place at each cashier point.

5.3. Working hours of the lift pass ticket offices are from 08:30 to 16:00, seven days a week.

5.4. At the discretion of the management of “VI AI HUNTING” Ltd., the ticket office working hours may be temporarily shortened.

5.5. “VI AI HUNTING” Ltd. issues and sells the following types of lift passes for the use of the cable facilities in the ski center of Malyovitsa:

5.5.1. Morning half-day lift pass, allowing the use of all operating cable facilities, transport belts, and slopes in the ski centers from 08:30 to 12:30.

5.5.2. Afternoon half-day lift pass, allowing the use of all operating cable facilities, transport belts, and slopes in the ski centers from 12:00 until the end of the operating hours.

5.5.3. One-day lift pass, allowing use of all operating cable facilities, transport belts, and slopes during their official operating hours.

5.5.4. Two-day, three-day, four-day, five-day, six-day, and seven-day lift passes, allowing use of all operating cableways, transport belts, and ski slopes within their operating hours from the date of purchase until the end of the validity period.

5.5.5. Lift pass for six non-consecutive days, allowing use of all operating cableways, transport belts, and ski slopes within their operating hours from the date of purchase until the end of the season in the Malyovitsa ski area.

5.5.6. Seasonal lift pass, allowing the use of all operating cableways, transport belts, and ski slopes within their operating hours from the date of purchase until the official end of the ski season in the Malyovitsa ski area.

*Note: The validity period of the seasonal lift pass is subject to change in case of unfavorable weather conditions or force majeure. “VI AI HUNTING” Ltd. reserves the right to change the official opening and closing dates of the ski season for safety reasons. In such cases, no compensation will be granted for unused days.

5.5.7. Seasonal passes for persons aged 7 to 18 are available at prices specified in the official price list.

5.5.8. Weekday seasonal lift pass is valid only on working weekdays and does not apply on public holidays or officially declared non-working days under Bulgarian labor law.

5.6. Seasonal passes issued on reusable cards contain the name and surname of the user.

5.7. Each lift pass includes insurance for passenger transport during use of cableways and transport belts, and accident insurance for the ski center (covering marked slopes and connecting routes) in Malyovitsa, valid only during the winter season. The insurance covers:

  • Search and rescue operations

  • First aid on the slope or at a mountain rescue post

  • Transportation of the insured person by specialized rescue transport to the nearest medical facility

5.8. Each pass holder must retain their lift pass and the corresponding receipt as proof of purchase for verification purposes.

5.8.1. Authorized personnel of “VI AI HUNTING” Ltd. are entitled to check the validity of lift passes during access control at the cableways.

5.8.2. The following lift passes are considered invalid:

  • Child pass used by a person over 12 years of age

  • Youth or senior pass used by someone unable to prove eligibility

  • Disability pass used by someone unable to prove eligibility

  • Pass with altered validity date or damage that prevents its identification

  • Pass used simultaneously by more than one person

5.9. Pass holders must present their lift pass upon request by authorized personnel.

5.10. Resale or distribution of lift passes outside the official ticket offices in the Malyovitsa resort area is prohibited.

5.11. Lift pass holders are not permitted to transfer or resell passes to others under any circumstances.

5.12. In the event of a violation, passes that are resold, tampered with, or used unlawfully may be revoked immediately by authorized personnel without compensation.

5.13. Terms for purchasing lift passes:

5.13.1. If multiple types of discounts apply, only one (of the customer’s choosing) may be used.

5.13.2. Morning half-day pass is valid until 12:30 on the date shown.

5.13.3. Afternoon half-day pass is valid after 12:00 until the end of the day on the date shown.

5.13.4. Children under the age of 7 use the lifts free of charge.

5.13.5. “7–13 incl.” rate applies to children aged 7 to 13.

5.13.6. “14–18 incl.” rate applies to persons aged 14 to 18, available at the ticket office upon presentation of valid ID or student card.

5.13.7. “19–63 incl.” rate applies to persons aged 19 to 63.

5.13.8. “64+” rate applies to persons aged 64 and above, with proof of age.

5.13.9. The 6 non-consecutive day pass does not permit use on two consecutive days without a break.

5.13.10. Night skiing pass allows access to lifts “Mecha Polyana 1,” “Mecha Polyana 2,” and “Transport Belt Mecha Polyana” from 18:00 to 21:00 on the date shown.

5.14. Instructions for issuing and recharging contactless reusable lift passes:

5.14.1. Contactless lift passes should be worn on the left side of the outer garment, preferably in a pocket between the left elbow and shoulder.

5.14.2. Gates will open automatically when approaching. Keep distance from the person ahead to ensure proper antenna function.

5.14.3. Do not keep the card close to a mobile phone, iPod, other mobile electronics, or foil packaging (gum wrappers, medicine blister packs, etc.).

5.14.4. Do not carry more than one card on the left side of your clothing.

5.14.5. Do not perforate or damage the surface of the card.

5.14.6. Lift passes are issued and sold exclusively by “VI AI HUNTING” Ltd. at its ticket offices.

5.14.7. When recharging reusable cards, BGN 1 is deducted from the standard price.

5.14.8. Reusable cards can be recharged online at www.malyovitsa.ski for the following services: half-day (morning or afternoon), 1 day, 2 days, up to 7 days.

5.14.9. Only one service may be active per reusable card at a time. A new recharge is possible only after the current pass has expired.

5.14.10. Reusable cards are durable and valid in future seasons unless changed by the issuer.

VI. CONDUCTING BUSINESS ACTIVITY – SNOW SPORTS TRAINING

6.1. Conducting commercial activity related to snow sports training on the territory of the Malyovitsa ski area is allowed only upon issuance of an official permit by “VI AI HUNTING” Ltd., available at the company’s ticket offices in the Malyovitsa resort.

6.2. The permit is issued only to individuals who meet legal requirements and under specific conditions determined by “VI AI HUNTING” Ltd.

6.3. The permit for conducting snow sports training is in a format established by “VI AI HUNTING” Ltd. It is personal and valid for one winter season. It is issued at a one-time cost of:
– BGN 1,200 – valid for one winter season.

6.4. In case of a violation in the use of the permit or any unauthorized use, the permit will be revoked without compensation, in accordance with the established rules for its issuance and use.

VII. COMPENSATIONS AND CLAIMS

7.1. “VI AI HUNTING” Ltd. bears no responsibility, does not refund lift pass payments, and is not liable for compensation if lift passes cannot be used due to one or more of the following reasons:

7.1.1. Power outage;

7.1.2. Adverse weather conditions — strong winds, heavy snowfall, lack of snow, extreme temperatures, fog, heavy rain, and others;

7.1.3. Partial closure of the ski area — individual slopes and/or lifts closed for safety reasons or in cases foreseen by applicable law;

7.1.4. Damage to or tampering with the lift pass resulting from improper storage or attempted interference;

7.1.5. Loss of the lift pass;

7.1.6. Cancellation of the lift pass due to non-compliance with these General Terms and Conditions;

7.1.7. Illness or injury of the lift pass holder during use;

7.1.8. Voluntary termination of the use of the lift pass before its expiration, regardless of the reason.

7.2. Upon receiving written complaints and claims, “VI AI HUNTING” Ltd. will make every effort to address customer concerns when they are deemed justified.

VIII. RULES FOR MONITORING COMPLIANCE WITH THE ESTABLISHED ORDER IN THE SKI CENTER OF THE MALYOVITSA RESORT

8.1. The monitoring of compliance with these General Terms and Conditions, the use of ski services by tourists, and safe behavior in the ski center of Malyovitsa, as well as the imposition of the specified sanctions, shall be carried out by employees of “VI AI HUNTING” Ltd. These employees are authorized to:

8.1.1. Conduct full monitoring of compliance with the established rules on the ski slopes and the associated facilities by users of the ski services within the ski center.

8.1.2. Monitor adherence to the rules for the use of the slopes and the cableways.

8.1.3. Prevent the use of the ski slopes and cableways by individuals displaying inappropriate behavior, visible intoxication, or under the influence of drugs.

8.1.4. Prevent the use of ski slopes and cableways in a manner that violates the mandatory safety rules outlined in Section IV, or that endangers the health and safety of the user or others.

8.1.5. Perform random checks for the validity of lift passes or tickets.

8.1.6. Respond to reports from tourists or other staff of “VI AI HUNTING” Ltd. concerning violations, access control, or safety concerns, and intervene when necessary.

8.1.7. Prevent unauthorized use of snowmobiles, ATVs, and bicycles on the ski slopes.

8.1.8. Evaluate daily conditions and issue recommendations or initiate actions for slope closures or restricted access where needed.

8.1.9. Issue warnings or mandatory safety instructions to skiers in the event of dangerous conditions.

8.1.10. Assist injured persons by securing the accident site and awaiting the arrival of medical or rescue personnel.

8.1.11. Request personal identification documents during inspections.

8.1.12. Issue verbal warnings to those who violate these General Terms and Conditions.

8.2. In the event of violations:

8.2.1. An official report is drawn up and signed by the violator or, if they refuse, by two witnesses;

8.2.2. Invalid or misused lift passes are immediately revoked and recorded in the report;

8.2.3. Individuals who repeatedly violate the rules, disobey staff, endanger others, or disrupt public order may be restricted from further use of the ski center.

8.3. Every user of services in the ski center of Malyovitsa must cooperate during checks by the authorized personnel of “VI AI HUNTING” Ltd.

IX. FINAL PROVISIONS

9.1. The Mountain Rescue Service of the Bulgarian Red Cross (BRC) can be reached by calling 1470 or 112.

9.2. Any user of ski services in the Malyovitsa ski area who purchases a lift pass or ticket from “VI AI HUNTING” Ltd. is considered to have accepted these General Terms and Conditions and is obliged to comply with them.

9.3. “VI AI HUNTING” Ltd. reserves the right to amend or supplement these General Terms and Conditions based on practical experience, in line with best practices from other ski areas, or to clarify their content. Changes take effect for third parties from the date of their official public announcement.

9.4. Any disputes arising in relation to the services covered by these General Terms and Conditions, or their interpretation and application, shall first be subject to negotiation. If no agreement is reached, the dispute shall be referred to the competent Bulgarian court. The applicable law is the current legislation of the Republic of Bulgaria.

TERMS AND CONDITIONS OF USE

II. GENERAL PROVISIONS

2.1. The ski slopes in the ski area of the Malyovitsa resort complex are accessible, secured, and clearly marked. The maintenance of the slopes is provided by qualified service personnel in accordance with safety standards, with the necessary equipment and technology for their upkeep, and in line with the specific weather conditions and terrain characteristics.

2.2. The passenger cableways (lifts) in the ski center at Malyovitsa resort are constructed and operated in accordance with the applicable legal regulations in the Republic of Bulgaria, meet safety requirements, are operated by qualified personnel, and are supervised by the relevant state authorities – the General Directorate “State Technical Supervision Inspection” in Sofia.

2.3. The working hours of the ski slopes in the ski center at Malyovitsa resort correspond with the working hours of the passenger cableways (facilities) serving them and are adapted to the current weather conditions and potential avalanche risk.

2.4. The management of “VI AI HUNTING” Ltd. has the right, at its discretion, to close ski slopes and passenger cableways for safety reasons in the following cases

in unsuitable specific snow or climatic conditions
in case of necessary technical maintenance of the cableway facilities
during grooming of the ski slopes
in other cases provided for in the applicable legislation

2.5. Tourists using the ski center at Malyovitsa resort are required to familiarize themselves with these general terms and rules for use and to unconditionally comply with their provisions. They must follow the instructions and restrictions publicly announced on the information boards located in the ski center, as well as the instructions given by the staff servicing the ski center regarding the correct use of ski slopes and cableways, in order to reduce the risk of accidents and to avoid interruptions in the operation of the facilities in the ski centers.

2.6. Tourists (and in the case of minors – their parents or adult companions) ski or snowboard on the slopes in the ski center at Malyovitsa resort at their own responsibility and at their own risk.

2.7. “VI AI HUNTING” Ltd. draws SPECIAL ATTENTION to all tourists and guests of the resort that engaging in snow sports (skiing, snowboarding, and others involving direct or indirect movement on snowy or icy surfaces) carries serious risks, and the responsibility for those risks lies entirely with each individual tourist. Skiing or learning to ski and/or snowboard, including other activities on snowy or icy surfaces, and using the cableways is a dangerous sport (activity) that can result in pain, serious injury, or death and/or property damage to the participant (tourist), and each tourist must assess their readiness to bear these risks in advance. “VI AI HUNTING” Ltd. bears no responsibility or any consequences for the quality of such assessment or its absence, including any adverse consequences of any kind – personal (non-material) or material – suffered by any user of the provided services (skier, snowboarder, tourist) or user of the ski centers in the resort.

2.8. The conditions on the slopes and trails in the ski center are subject to constant change due to weather conditions and their use, and this represents part of the risks associated with engaging in snow (winter) sports. Other such risks, though not exhaustively listed, include changes in the characteristics of the snow, slope, and terrain, ice and icing, irregularities, exposed rocks, trees and other forms of forest vegetation or debris (above and below the surface), bare patches, lift poles, equipment and poles for electric and other utility networks, fences or lack thereof, snowmaking equipment, snow grooming machinery and their components, motor vehicles on snow, and other obstacles created by nature or humans and features of the terrain within or outside the marked slopes and trails, as well as collisions with equipment, obstacles, or other participants in snow (winter) sports, including power outages and the resulting stoppage of cableways and ski belts.

2.9. “VI AI HUNTING” Ltd. WARNS AND INFORMS that all risks mentioned, even if not exhaustively, in these general terms and conditions pose a serious danger of discomfort (physical and/or emotional), traumatic injuries of varying degrees, serious damage to health, and even death.

2.10. Before starting to use the services provided in the ski center at Malyovitsa resort and in particular by “VI AI HUNTING” Ltd., each tourist is obliged to carefully assess their current mental and physical condition, the specific snow/climatic conditions and their possible rapid change, whether they are capable and possess the necessary level of skill to perform the respective activities – skiing/snowboarding on the slopes in the ski center and/or using the associated cableways (lifts, drag lifts, including ski belts), as well as to make a mandatory assessment of their readiness to bear the risks referred to in these general terms. Any consequence of failure to make such an assessment or of an inaccurate one shall be entirely the responsibility and at the expense of the person (skier, snowboarder, tourist, etc.) who has failed to make it or made it incorrectly.

2.11. Tourists (and in the case of minors – their parents or adult guardians) bear full personal responsibility for the condition of their equipment and the correct adjustment of ski/snowboard bindings and must maintain their equipment in working order.

2.12. “VI AI HUNTING” Ltd. assumes no liability and does not pay compensation of any kind for any injuries, other damage and/or death resulting from accidents involving tourists in the ski center that are not solely due to the conduct of “VI AI HUNTING” Ltd. To avoid any doubt, each user of services provided by “VI AI HUNTING” Ltd. is informed of this lack of liability through publicly available access to these general terms and conditions, provided at the ticket offices, and cannot claim compensation from “VI AI HUNTING” Ltd., its owners, or staff for injuries, inconvenience and/or harm sustained during use of the facilities or services provided by “VI AI HUNTING” Ltd.

2.13. The price of the lift pass provided by “VI AI HUNTING” Ltd. to its customers includes accident insurance valid only during the winter season and only for marked slopes and the connections between them during the declared working hours. The insurance includes

first aid on the ski slope
free transportation of the injured person using a specialized rescue vehicle to a medical station

2.14. “VI AI HUNTING” Ltd. assumes no responsibility and is not required to provide or cover the cost of insurance for the main risks – death and permanent loss of working capacity, medical expenses, and repatriation – for tourists using services in the ski center at Malyovitsa resort. Each tourist may, at their discretion, purchase individual insurance with such coverage.

III. BASIC RULES FOR USING THE SKI CENTER

3.1. The working hours of all ski slopes are aligned with the working hours of the cableways that serve them and operate without rest days, except in cases of extraordinary events requiring the closure of ski slope(s).

3.2. Skiing or snowboarding on the ski slopes outside the announced working hours and after the declared closing time is not permitted.

3.3. The use of cableways and/or skiing or snowboarding by persons who are visibly intoxicated and/or under the influence of narcotic or intoxicating substances is not allowed.

3.4. The operation of snowmobiles and ATVs on the ski slopes of the ski center is prohibited both during the day and at night. Exceptions are made only in cases of emergency medical assistance, police intervention, or technical problems with the facilities of “VI AI HUNTING” LTD.

IV. MANDATORY RULES FOR SAFE CONDUCT OF TOURISTS AND SKIERS IN THE SKI CENTER OF MALIovitsa RESORT COMPLEX

4.1. General rules

4.1.1. Every skier/snowboarder/cross-country skier must use only designated and open ski slopes and must comply with all posted markings and signs.

4.1.2. Skiing outside the designated slopes, outside the announced working hours and after the closing time of the respective ski center, as well as disregarding closed slopes or their sections, is prohibited and in all cases is done at one’s own risk and responsibility.

4.1.3. All tourists must behave on the slopes and when using cableways in a way that does not endanger or hinder themselves or other tourists.

4.2. Rules of conduct for tourists using skis or snowboards

4.2.1. The rules apply to all users of skis or snowboards in Malyovitsa resort. Every skier or snowboarder must be familiar with and comply with them.

4.2.2. Users engaging in skiing or snowboarding must

  1. adjust their speed and manner of movement to their abilities, terrain characteristics, snow cover, weather conditions, and traffic load; avoid endangering or hindering other skiers and snowboarders; maintain full control over their skis or snowboard so they can change direction or stop when necessary

  2. reduce speed in areas with poor visibility, near construction sites or obstacles, at crossings, junctions, in fog, in crowded areas, on narrow passages, or when beginners are present

  3. be responsible not only for their behavior on the slope but also for the proper condition of their equipment, including when using unconventional gear (modified, prototype, etc.)

  4. observe the following slope traffic rules:

a) persons in front have right of way; those approaching from behind must not endanger them and must keep an appropriate distance

b) when overtaking, the overtaker must leave enough space for any deliberate or unintentional movement of the person being overtaken; the overtaker is fully responsible for performing the maneuver safely, including when overtaking stationary skiers or snowboarders

c) stopping on narrow or poorly visible slope sections is allowed only in emergencies; the person must move aside as soon as possible; re-entering the slope must be done safely without collision risk

d) after a fall, the slope must be cleared as quickly as possible

e) at intersections, those approaching from the right have priority

f) ascending or descending without skis or snowboards must be done off to the side of the slope

  1. comply with all signs and markings and use slopes appropriate for their technical and physical skill level

  2. yield to piste and rescue services, as well as designated vehicles, and in no way obstruct their movement

  3. in the event of an accident, secure the injured person and immediately notify rescue services at 1470 or 112

4.3. All other alternative forms of descent on the ski slopes and their connections are prohibited, including but not limited to: ski/snow bikes, airboards, paragliding takeoff or landing on the slope, fat bikes, etc.

4.4. Sledding is only allowed in one specifically designated, separate, and secured section of the ski zone.

V. CONDITIONS FOR ISSUANCE, SALE, VALIDITY AND USE OF LIFT PASSES FOR THE CABLE FACILITIES IN THE SKI CENTER OF MALIovITSA RESORT

5.1. All types of lift passes for the use of the cable facilities in the ski center of Maliovitsa Resort are issued and sold solely and exclusively by “VI AI HUNTING” Ltd. at the company’s ticket offices located at Mecha Polyana and at the reception desk of Hotel “Maliovitsa”.

5.2. The prices of the various types of lift passes are in Bulgarian leva including VAT and are announced by “VI AI HUNTING” Ltd. on the ski area’s website as well as at each ticket office where lift passes are sold. The price list is displayed in a visible location at the company’s cash desks.

5.3. The working hours of the ticket offices for the sale of lift passes are from 08:30 to 16:00 without a day off.

5.4. At the discretion of the management of “VI AI HUNTING” Ltd. the working hours of the ticket offices may be incidentally shortened.

5.5. “VI AI HUNTING” Ltd. issues and sells the following types of lift passes for the use of the cable facilities in the ski center of Maliovitsa Resort:

5.5.1. Morning half-day lift pass allowing the use of all operating cable facilities, conveyor ski belts and slopes in the ski centers from 8:30 to 12:30

5.5.2. Afternoon half-day lift pass allowing the use of all operating cable facilities, conveyor ski belts and slopes in the ski center in the afternoon from 12:00 until the end of the working hours of the cable facilities

5.5.3. One-day lift pass allowing the use of all operating cable facilities, conveyor ski belts and slopes in the ski centers during their working hours

5.5.4. Two-day, three-day, four-day, five-day, six-day and seven-day lift passes allowing the use of all operating cable lines, conveyor ski belts and slopes in the ski centers during the working hours of the cable facilities from the date of purchase until the end of the working hours of the ski centers on the date of expiry

5.5.5. Six non-consecutive day lift pass allowing the use of all operating cable lines, conveyor ski belts and slopes in the ski centers during the working hours of the cable facilities from the date of purchase until the end of the working hours on the date of ski season closure in the ski area of Maliovitsa Resort

5.5.6. Seasonal lift pass allowing the use of all operating cable lines, conveyor ski belts and slopes in the ski center during the working hours of the cable facilities from the date of purchase until the end of the working hours on the date of ski season closure in the ski area of Maliovitsa Resort

  • Note: The validity period of the seasonal lift pass is subject to change in case of adverse weather conditions or other force majeure circumstances. “VI AI HUNTING” Ltd. reserves the right to change the ski season opening and closing dates at its discretion in case of factors and circumstances threatening the safety of customers. In such case, customers who purchased seasonal lift passes are not entitled to compensation for unused days of the validity period stated on the passes.

5.5.7. Seasonal passes for persons who have reached 7 but not yet 19 years of age are sold at the ticket offices at prices specified in the Price List.

5.5.8. The weekday seasonal lift pass is valid on working weekdays for all facilities. This lift pass is not valid on official public holidays listed in Art. 154, para. 1 of the Labour Code, as well as on weekday non-attendance days determined pursuant to Art. 154, para. 2 of the Labour Code.

5.6. Seasonal lift passes issued on reusable media contain the first and last name of the holder.

5.7. The price of each purchased lift pass includes insurance for transportation of passengers by cable transport facilities and conveyor ski belts, as well as accident insurance within the ski center (covering the marked slopes, roads and interconnections) in Maliovitsa Resort, valid only during the winter season and covering search and rescue operations in case of accident on the slopes, first aid at the slope or mountain rescue post and transportation of the insured person using special rescue means to the nearest medical center.

5.8. Every person who has purchased a lift pass is required to retain the pass and the purchase receipt for verification of its validity by authorized personnel.

5.8.1. Authorized to perform checks on lift passes used by tourists approaching the cable facilities are employees of “VI AI HUNTING” Ltd. responsible for access control and monitoring compliance with the rules of the ski area on the ski slopes.

5.8.2. A lift pass is considered irregular under these general terms and conditions in the following cases:

a child pass used by a person who has turned 12 years of age
a pass for persons aged 14–18 and 64+ used by someone who cannot prove entitlement at the time of inspection
a pass for a person with disabilities used by someone who cannot prove entitlement at the time of inspection
a pass with altered validity or one that is damaged such that the validity period cannot be determined
a pass being used simultaneously by two persons

5.9. Every person who has purchased a ticket or lift pass must present it upon request by authorized personnel for validity inspection.

5.10. Selling outside the ticket office and reselling of lift passes within the territory of Maliovitsa Resort is prohibited.

5.11. Persons who have purchased lift passes are not entitled to transfer or resell them to others under any circumstances.

5.12. In case of violations established by authorized personnel, transferred/sold/resold/falsified lift passes are annulled and confiscated.

5.13. Conditions for the purchase of lift passes for the lift facilities in Maliovitsa Resort:

5.13.1. When entitled to more than one discount, only one may be used (no accumulation), chosen at the discretion of the entitled person.

5.13.2. The morning half-day pass is valid until 12:30 on the date indicated on the pass.

5.13.3. The afternoon half-day pass is valid from 12:00 until the end of the working hours on the date indicated on the pass.

5.13.4. Children under the age of 7 use the lift facilities free of charge.

5.13.5. The “7–13 incl.” lift pass prices apply to children aged 7 to 13 years.

5.13.6. The “14–18 incl.” lift pass prices apply to persons aged 14 to 18 years and are sold in person at the ticket office upon presentation of ID, validated student card or university book.

5.13.7. The “19–63 incl.” lift pass prices apply to persons aged 19 to 63 years.

5.13.8. The “64+” lift pass prices apply to persons over 64 years of age and are sold in person at the ticket office upon presentation of ID.

5.13.9. The six non-consecutive day lift pass does not entitle the holder to use the facilities on two consecutive days without interruption.

5.13.10. The night skiing lift pass entitles the holder to use the ski tows “Mecha Polyana 1”, “Mecha Polyana 2” and “Mecha Polyana Conveyor Belt” within their announced operating hours for night skiing, valid from 18:00 to 21:00 on the date indicated on the pass.

5.14. Instructions for issuing and recharging contactless lift passes on reusable media:

5.14.1. CONTACTLESS lift passes on reusable media must be worn on the left side of the outer garment/ski jacket – preferably in a pocket between the left elbow and shoulder.

5.14.2. When approaching the access gates, they will open automatically. Please keep a distance from the person in front of you to ensure proper antenna function.

5.14.3. The pass must not be kept close to a mobile phone, iPod or near other mobile devices or foil wrappers (e.g. chewing gum, medicine blister packs etc.).

5.14.4. Do not carry more than one pass on the left side of your clothing/jacket.

5.14.5. Do not perforate or damage the surface of the cards in any way.

5.14.6. Lift passes for the ski facilities in Maliovitsa Resort are issued and sold solely and exclusively by “VI AI HUNTING” Ltd. at the company’s ticket offices.

5.14.7. When recharging reusable media, 1 BGN is deducted from the listed prices in the price list.

5.14.8. Reusable media can be recharged online through the website www.malyovitsa.ski with the following services: 1/2 day morning, 1/2 day afternoon, 1 day, 2 days, 3 days, 4 days, 5 days, 6 days, 7 days.

5.14.9. Only one active service can be stored on a reusable card. Recharging a new service is possible after the expiry of the previous one.

5.14.10. Reusable media are durable and can be used in future seasons until their format is changed by the issuer.

VI. CONDUCTING BUSINESS ACTIVITIES – SNOW SPORTS INSTRUCTION

6.1. Conducting business activities involving snow sports instruction within the territory of the Maliovitsa ski area shall be carried out only after the issuance of a permit for conducting such activity by “VI AI HUNTING” Ltd. at the company’s ticket offices in Maliovitsa Resort.

6.2. The permit is issued only to persons who meet the regulatory requirements and under specific conditions determined by “VI AI HUNTING” Ltd.

6.3. The permit for conducting business activities in snow sports instruction is in a format determined by “VI AI HUNTING” Ltd. It is personal and valid for one winter season. It is purchased at the company’s ticket offices at a one-time fee of:
– BGN 1200 – valid for one winter season.

6.4. In case of violation in the use of the permit for conducting snow sports instruction or its use in an unauthorized manner, it shall be revoked without the right to compensation, in accordance with the rules for its issuance and use.

VII. COMPENSATIONS AND CLAIMS

7.1. “VI AI HUNTING” Ltd. bears no responsibility, does not refund the value of purchased lift passes, and is not liable for monetary compensation in cases where the purchased lift passes cannot be used due to one or more of the following reasons:

7.1.1. Power outage;

7.1.2. Adverse weather conditions – strong wind, heavy snowfall, lack of snow, extremely low or high temperatures, fog, torrential rain, and others;

7.1.3. Partial closure of the ski area – individual ski slopes and/or lifts, for safety reasons or as provided by applicable legislation;

7.1.4. Damage to or alteration of the lift pass due to improper storage or use, or due to attempted tampering;

7.1.5. Loss of the lift pass;

7.1.6. Cancellation of the lift pass due to violation of a provision of these general terms and conditions;

7.1.7. Illness or accident of the lift pass holder occurring during its use;

7.1.8. Termination of the use of the pass before the end of its validity period by the purchaser, regardless of the reason.

7.2. Upon receipt of written complaints and claims, “VI AI HUNTING” Ltd. will make every effort to satisfy customer requests when they are justified.

VIII. RULES FOR MONITORING COMPLIANCE WITH THE ESTABLISHED ORDER IN THE SKI CENTER OF MALIOVITSA RESORT

8.1. Monitoring of compliance with the rules established in these General Terms and Conditions for the use by tourists of the ski services provided and the rules for safe conduct in Maliovitsa Resort, as well as enforcement of the sanctions set out in these General Terms and Conditions, is carried out by employees of “VI AI HUNTING” Ltd. The employees have the following powers:

8.1.1. To exercise full control over compliance with the established order on the ski slopes and their servicing facilities in the ski center, including by the users of services within the ski center’s territory

8.1.2. To monitor compliance with the rules for the use of the ski slopes and the servicing cable lines

8.1.3. To prevent persons with inappropriate behavior, visibly intoxicated and/or under the influence of narcotic substances, from using the ski slopes and cable lines in the ski center of Maliovitsa

8.1.4. To prevent persons from using the ski slopes and cable lines in the ski center of Maliovitsa in a manner that violates the mandatory safety rules under Section IV and/or endangers their own health and safety or that of other tourists in the ski center

8.1.5. To carry out random inspections for the validity of the lift pass or ticket being used

8.1.6. To respond to reports from tourists or employees of “VI AI HUNTING” Ltd. who provide security and control access to the cable lines, and to assist in the event of violations of the General Terms and, if necessary, detain offenders

8.1.7. To prevent unauthorized operation of snowmobiles, ATVs, and bicycles on the ski slopes in the ski center

8.1.8. To assess the conditions for practicing snow sports during the workday and provide information on measures for closing slopes or sections thereof

8.1.9. In the event of danger, to signal and issue mandatory instructions to skiers on how to behave in such a situation

8.1.10. To assist injured persons by securing the accident site and waiting for the arrival of medical personnel or a rescue team

8.1.11. During inspections, to request identification documents from the persons being inspected

8.1.12. While performing their official duties, to issue warnings to persons who do not comply with the rules established in these General Terms and Conditions

8.2. Upon establishing violations:

8.2.1. They shall draw up a report documenting the violation, which shall be signed by the offender or, if they refuse, by two witnesses

8.2.2. They shall immediately cancel any irregular lift passes discovered during inspections, as well as the lift passes of violators of these General Terms and the rules established therein, which shall be recorded in the report

8.2.3. They may restrict access to the ski center for tourists who do not comply with these General Terms, do not follow the instructions of the personnel, or whose actions endanger public safety or disturb public order

8.3. Every user of services in the territory of the ski centers in Maliovitsa Resort is required to cooperate during inspections carried out by employees of “VI AI HUNTING” Ltd.

IX. FINAL PROVISIONS

9.1. The Mountain Rescue Service of the Bulgarian Red Cross (MRS of the BRC) can be reached at tel. 1470 or 112

9.2. Every user of ski services in the territory of the Maliovitsa ski zone who has purchased a lift pass or ticket from the cash desks of “VI AI HUNTING” Ltd., by the act of purchasing or using the pass, expresses their agreement with the rules established in these General Terms and Conditions and undertakes to comply with them

9.3. “VI AI HUNTING” Ltd. reserves the right to amend and supplement these General Terms and Conditions based on observed cases in practice and/or in line with good practices from other ski areas and/or for the purpose of clarification of these General Terms and Conditions. The amendments shall take effect for third parties from the date of their public announcement at the locations specified in the preceding provision

9.4. Any disputes arising in connection with the services provided under these General Terms and Conditions, as well as in connection with their interpretation and application, shall be resolved through negotiation. In case of failure to reach agreement, the dispute shall be referred to the competent Bulgarian court. The provisions of the applicable Bulgarian legislation shall apply.
